AND TERRITORIES).

AGE OR OLDER AS OF THE DATE OF ENTRY.

1) GENERAL/TIMING:
The One Hundred Thousand Dollar Challenge (the “Competition”) begins 12:00 PM (noon) Eastern Time (“ET”) on August 15, 2008
and ends on or about 8:00PM ET on Sunday December 30, 2008. ("Competition Period")
The Competition is sponsored by NBC Sports and NBC Universal, Inc. (collectively “NBCU” or “Sponsor”).

2) HOW TO ENTER:
There is no entry fee to enter the Competition. To
enter the Competition, during the Competition Period, you must register at http://100k.nbcsports.com
(the “$100K Challenge Website”). You will be asked to fill in and submit the
registration information including your name, email address, zip code, birth
date and other information and you will receive a confirmation email with your
ID and password and other information about the Competition. You will also be
asked if you wish to receive promotional materials and Competition reminders
from Sponsor. Your consent to receive these materials is optional. Even if you
consent, you may subsequently unsubscribe by clicking on the “unsubscribe” link
in any promotional materials you receive.

3) ELIGIBILITY:
Entrants must be legal permanent residents of and must
physically reside in one of the 50 United States and must be 21 years of age or
older as of the date of entry. Void in
Puerto Rico, the U.S. Virgin Islands, Guam, and U.S. Military installations in
foreign countries, anywhere outside of the 50 United States and where
prohibited by law. Employees and their immediate families, including household
members, of NBCU, AllStar Stats, Inc. and/or of each of their respective parent
companies, subsidiaries and affiliates, and of their respective distributors,
suppliers, participating vendors, promotion or advertising agencies, or of any
other company or person involved with the design, production, execution or
distribution of the Competition (collectively, Sponsor’s “Promotional
Partners”) are NOT eligible to enter.

4) HOW TO PLAY:
-
A. GENERAL
The Competition is a fantasy football
based game where each week of the Competition Period entrants create a One
Hundred Thousand Dollar Challenge Team (an entrant’s “$100K Team”) by 1)
selecting from a pool of Sponsor-designated players from National Football
League (“NFL”) rosters (the “Players” and collectively, the “Pool”) to fill the
first ten (10) $100K Roster Positions listed below and 2) selecting a
single team from all of the NFL teams scheduled to play that week to fill the
eleventh (11th) $100K Roster Position listed below, which eleventh
(11th) $100K Roster Position will constitute entrant’s defense and
special teams on his/her $100K Team (an entrant’s “Defense/Special Team”).
The Pool may change during any given week
of the Competition Period if Sponsor chooses to add or remove Players who have
been added to or removed from NFL rosters during the Competition Period.
As explained further below, the tenth (10th)
$100K Roster Position on an entrant’s $100K Team each week is a bonus player
who is an individual NFL offensive player from the Pool who is on one of the
teams playing in that week’s NBC Sunday Night Football game (an “NBC SNF
Player”).
Defense/Special Team roster position
consists of the players on the NFL team selected by the entrant as his/her
Defense/Special Team who play on defense or special teams for that NFL team
during the corresponding week.
Each entrant will receive fantasy points
(“Fantasy Points”) each week based upon the performance of the $100K Team
entrant has selected for that week (i.e., the performance of his/her first ten
(10) $100K Roster Position Players and the Defense/Special Team at his/her
number eleven (11) $100K Roster Position). Entrants will be ranked (as compared to other entrants) for the
cumulative Fantasy Points that they receive from week 1 through week 12 of the
NFL Season (the “Regular Season Contest”).
After the Regular Season Contest is completed,
entrants who qualify either 1) by having received enough Fantasy Points (see
“Qualification for Playoffs” section below) or 2) by selecting the “Perfect
Picks” (see below) in any single week during the Regular Season Contest will be
eligible to compete in the Playoff Round for the Playoff Round prizes.
All other entrants will be eligible to
compete in the Consolation Round for the Consolation Round prizes. Both the Playoff Round and the Consolation
Round will have the same weekly rules described herein as for the Regular
Season Contest but the Playoff Round and the Consolation Round will aggregate
Fantasy Points received from selections in weeks 13 through 17 of the NFL
Season (rather than in weeks 1 through 12 as for the Regular Season Contest).(The Playoff and Consolation Rounds will also
not include any “Perfect Picks.”)
Entrants will be allowed to create, invite and join private groups. These private groups will allow entrants to view standings and
selections for the entrants who are attached to that particular group.
Some examples of groups that entrants might
create for themselves are family, friends, college friends, softball buddies,
etc. These groups are for personal enjoyment only and have no bearing on the results of the Competition.

B. Local Stations $100K Team Competition:
Each entrant shall choose his/her local
NBC television station (i.e., an NBC affiliate) at the time of registration (a
“$100K Team NBC Local Affiliate Group”). Those entrants in a region covered by two or more NBC affiliate
television stations will be asked to choose one NBC affiliate at the time of
registration. (Note: Entrants must
select the NBC affiliate that corresponds to their address or they may forfeit
any prizes won.) Entrants will be able
to see standings for all $100K Teams in their respective $100K Team NBC Local
Affiliate Group on the $100K Challenge Website and are eligible to qualify for
the Playoff Round based on their performance in their NBC Local Affiliate Group
(see details below).

C. Perfect Picks:
Each week when entrants make their
selections for their $100K Team on the $100K Challenge Website during the
Regular Season Contest, each entrant will also have the opportunity to select
his/her best guess at the perfect fantasy line-up (an entrant’s “Perfect
Picks”) during that week as another means of qualifying for the Playoff
Round. In other words, in addition to
the chance at qualifying for the Playoff Round by having received enough
Fantasy Points during the Regular Season Contest (see “Qualification for
Playoffs” section below), entrants may also qualify for the Playoff Round if
they are among the entrants (see below) who make “Perfect Picks” during any
week during the Regular Season Contest. (The Playoff Round and the Consolation Round will not include any
“Perfect Picks” method of qualifying or winning.)

5) SELECTING A $100K TEAM EACH WEEK:
-
A. General:
Entrants will use the $100K Challenge
Website to select their $100K Team each week. The $100K Challenge Website will take users through a series of pages
where they will create their weekly $100K Teams by 1) selecting Players from
the Pool at the first ten (10) $100K Roster Positions and 2) selecting a
Defense/Special Team from among all of the NFL teams scheduled to play that week
at the eleventh (11th) $100K Roster Position. Entrants will submit
their completed $100K Team on the $100K Challenge Website each week, which will
qualify as an entry into the Competition.

B. $100K Roster Positions:
Each week of the Competition Period each
entrant will select Players from the Pool and a Defense/Special Team for the
following $100K Roster Positions in order to form his/her $100K Team for that
week:

After the first time an entrant chooses a
Player from the Pool for his/her $100K Team in any given week in any of the
first nine (9) $100K Roster Positions (the “Regular $100K Roster Positions”),
the entrant may not then select that Player as a member of his/her $100K Team
(in any of the Regular $100K Roster Positions) in any subsequent week for the
remainder of the Regular Season Contest (except that any such Player may be
selected as an NBC SNF Player in a subsequent week, as explained further
below). Also, entrants may only select
Players in the Regular $100K Roster Positions at the positions that they have
been designated as playing in the Pool. For example, if a Player in the Pool is designated as a Wide Receiver
(Marvin Harrison, e.g.), he can only be picked in one of the Wide Receiver
Regular $100K Roster Positions.
All Players selected by an entrant as
part of his/her $100K Team (in any $100K Roster Position) are considered
Starting Players, meaning that all statistics for that Player count towards the
entrant’s Fantasy Points scoring once that Player has been finally selected by
the entrant.

C. Selecting an NBC SNF Player Each Week:
Entrants will select their NBC SNF Player
(i.e., their tenth (10th) $100K Roster Position) (the “Bonus $100K
Roster Position”) each week from any offensive Player who is on the roster of
one of the two teams playing in that week’s NBC Sunday Night Football
Game. Unlike selecting a Player for one
of the Regular $100K Roster Positions on entrant’s $100K Team, the NBC SNF
Player can be a Player who has previously been selected by an entrant for
his/her $100K Team (i.e., in one of his/her Regular $100K Roster Positions) in
a previous week of the Regular Season Contest. Also unlike the entrant’s selections in the Regular $100K Roster
Positions, if a Player is selected by the entrant as his/her NBC SNF Player in
one week, the entrant may select that Player again in a subsequent week as
his/her NBC SNF Player if that Player’s team plays another NBC Sunday Night
Football Game (assuming that the Player is still on the team’s roster at that
time and, as such, is still in the Pool). For example, if in Week 1 an entrant chooses Tom Brady (New England
Patriots Quarterback) on his/her $100K Team (e.g., in the first (1st)
Regular $100K Roster Position), then Tom Brady cannot be selected for the rest
of the Regular Season Contest in any of the Regular $100K Roster Positions on
that entrant’s $100K Team; however, Tom Brady may still be selected in
subsequent week(s) as that entrant’s designated NBC SNF Player (e.g., in Week 2
and then again in Week 12 as the New England Patriots will be playing in NBC’s
Sunday Night Football Game in both of those weeks). At the same time, and subject to the restriction on the number of
times a Player can be selected in a Regular $100K Roster Position (i.e., once),
an entrant may select a Player in one of the $100K Regular Roster
Positions and as his/her NBC SNF Player in the same week. In other words, in any given week a Player
in the Pool may be selected in one of the entrant’s Regular $100K Roster
Positions (if the entrant has not previously selected that Player in a Regular
$100K Roster Position) and as his/her NBC SNF Player (in the same week),
if the entrant chooses to do so. An
entrant cannot pick a Defense/Special Team as his/her NBC SNF Player in any
week.
(Note ?????????? There is no NBC Sunday Night Football Game on October 28,
2008 ???????????. Therefore, Sponsor will designate
another NFL game played that week as a substitute NBC Sunday Night for that
week, and entrants may select their Bonus $100K Roster position for that week
from Players in the Pool who will be on the rosters of the two teams playing in
that week’s game designated by Sponsor as the NBC Sunday Night Football Game
for that week. For example, Sponsor may
designate one of the afternoon games on October 28, 2007 as the NBC Sunday
Night Football Game for that week from which entrants may select their NBC SNF
Player for that week from among the Players in the Pool who are on the rosters
of either of the two teams playing in that game.)

D: Selecting a Defense/Special Team Each Week:
Entrants will also use the $100K
Challenge Website to select their Defense/Special Team each week. Entrants may select their Defense/Special
Team from any one of the thirty-two (32) NFL teams scheduled to play during the
applicable week. Unlike the Regular and
Bonus $100K Roster Positions, entrants do not pick individual Players when they
select their Defense/Special Team. Instead, they pick one (1) NFL team that is playing that week. For example, if the entrant picks the Indianapolis
Colts as his/her Defense/Special Team during a given week, the entrant will
earn Fantasy Points (see below) for plays made by any Indianapolis Colts
players (regardless of whether they are in the Pool) or by the Indianapolis
Colts team as a whole while those players and/or the team is on the field on
defense or in a special teams capacity. Once an entrant has selected an NFL team as his/her Defense/Special Team
in any given week, that NFL team cannot be selected as the entrant’s
Defense/Special Team again for the remainder of the Regular Season
Contest. A Defense/Special Team can
also not be selected as an entrant’s NBC SNF Player.

7. SELECTING PERFECT PICKS EACH WEEK:
During each week of the Regular Season Contest, entrants
will also be allowed to submit their best guess at the “perfect” fantasy
line-up for that week (and, as such, try by another means to qualify for the
Playoff Round) by selecting Players from the Pool (an entrant’s “Perfect
Picks”) for the following Perfect Picks Roster Positions:
- Quarterback
- Running Back
- Wide Receiver
- BONUS PERFECT PICKS ROSTER POSITION (NBC SNF Player)
The goal of the Perfect Picks is to
select the highest Fantasy Point scoring Player at each of the above listed
Perfect Picks Roster Positions based on the scoring set forth in these rules
(see below). Unlike an entrant’s
selections for his/her $100K Team, an entrant may select a Player as one of
his/her Perfect Picks in more than one (1) week during the Regular Season
Contest. For example, an entrant may
select Peyton Manning (of the Indianapolis Colts) at the first (1st)
Perfect Picks Roster Position in connection with his/her Perfect Picks in more
than one (1) week during the Regular Season Contest. In other words, unlike the Regular $100K Roster Positions
selections each week, there are no restrictions on the number of weeks in which
a Player may be selected as one of an entrant’s Perfect Picks. However, within a given week, an entrant may
not pick the same Player in more than one Perfect Picks Roster Position, except
that an entrant may select a Player at his/her Bonus Perfect Picks Roster
Position who they may have already selected at one of the three (3) other
Perfect Picks Roster Positions (within the same week or in a different
week). (For example, Drew Brees could
be selected within the same week by an entrant at the Perfect Picks Quarterback
Roster Position and at the Bonus Perfect Picks Roster Position, if the
New Orleans Saints are playing in the NBC Sunday Night Football Game that
week).
With respect to choosing the Bonus
Perfect Picks Roster Position (i.e., an NBC SNF Player), the entrant may select
either the Player he/she already selected as his/her regular NBC SNF Player (on
his/her $100K Team) or a different Player as his/her guess as to the Player who
will be the highest Fantasy Point scoring Player of any Player in the Pool
playing in the NBC Sunday Night Football Game during that week.

8. DEADLINE FOR MAKING SELECTIONS:
The deadline each week for an entrant to
select any Player from the Pool 1) for an entrant’s $100K Team or 2) as one of
an entrant’s Perfect Picks is the respective scheduled start time of each such
Player’s game (the “Player’s Start Time”). Once a Player’s Start Time has passed, that Player cannot be selected by
an entrant for his/her $100K Team or as one of his/her Perfect Picks in that
week. Similarly, if an entrant has
selected a Player for his/her $100K Team (or as one of his/her Perfect Picks)
prior to the Player’s Start Time, the entrant cannot remove that Player from
his/her $100K Team (or from his/her Perfect Picks) after the Player’s Start
Time has passed. In either case, such
Players are considered LOCKED once such Player’s Start Time has
passed. For example, if an entrant
wants to select a Player from the Pool for his/her $100K Team in any given
week, and that Player’s team is scheduled to play on Thursday night that week,
the entrant must select that Player for his/her $100K Team during that week
before the scheduled start time of the Player’s game on that Thursday
night. As another example, Players
playing in the Sunday night NFL game can be selected for an entrant’s $100K
Team up until the scheduled start of that game on Sunday night, and once the
scheduled start time of that game has passed on Sunday night, Players playing
in that game are locked and cannot be selected or removed from an entrant’s
$100K Team (or as one of his/her Perfect Picks, as the case may be) for that
week.
The deadline each week for an entrant to
select his/her Defense/Special Team is the respective scheduled start time of
the corresponding NFL team’s game during that week (an “NFL Team’s Start
Time”). Once an NFL Team’s Start Time
has passed, that NFL team cannot be selected by an entrant as his/her
Defense/Special Team in that week. Similarly, if an entrant has selected a Defense/Special Team prior to
its NFL Team’s Start Time, the entrant cannot de-select that NFL team as
his/her Defense/Special Team after that NFL Team’s Start Time has passed. In either case, such NFL teams are
considered LOCKED once such NFL Team’s Start Time has passed.

9. FANTASY POINTS SCORING
- A. General:
Entrants shall receive Fantasy Points
each week according to the point designations listed below based upon plays
made in the regular season NFL games (played in the same week) 1) by the
Players the entrant selected on his/her $100K Team in the Regular and Bonus
$100K Roster Positions for that week and 2) by the NFL team the entrant
selected as his/her Defense/Special Team (i.e., the eleventh (11th)
$100K Roster Position) for that week. An entrant’s Perfect Picks each week will also be scored and ranked
based upon the plays made that week by the Players entrant selected in each of
the Perfect Pick Roster Positions (for that week) according to the point
designations below.

Note: Fantasy Points will not be deducted
(i.e., negative Fantasy Points will not be scored) for negative yardage totals.
Each week, an entrant will receive
Fantasy Points and his/her Perfect Picks will be ranked regardless of the
position that any Player they selected for that week plays on the field. For example, if an entrant selected a Player
in his/her ”Running Back 1” $100K Roster Position, the entrant will receive
Fantasy Points if that Player throws a touchdown pass.
B. NBC SNF Player
(i.e., the Bonus $100K Roster Position) Scoring:
Fantasy Points received by an entrant for
plays made by his/her NBC SNF Player will be doubled. (Note: If an entrant does not select an NBC SNF Player in any
given week, the entrant will receive no Fantasy Points related to the selection
of an NBC SNF Player in that week.)
C. Defense/Special
Team Scoring:
Entrants will receive Fantasy Points for
plays made by the Defense/Special Team that they select in any given week only
in accordance with the Defense/Special Team Scoring points chart listed
above. For example, if a Player who is
normally a wide receiver also plays on defense (so that such Player is part of
an entrant’s Defense/Special Team) and that Player returns an interception for
a touchdown, the Player DOES NOT earn six (6) Fantasy Points for his wide
receiver position (i.e., as if he had been selected as one of entrant’s Regular
$100K Roster Positions or as entrant’s NBC SNF Player, for example). Instead, the entrant’s Defense/Special team
(for which the Player plays) earns the Fantasy Points.
The “Total Points” category of
Defense/Special Team scoring is calculated as the total team points scored
against an entrant’s selected Defense/Special Team and will not take into
account whether the opposing team’s offense or defense scored the points. For example, if an entrant selects the Minnesota
Vikings as his/her Defense Team and the Vikings are playing the Chicago Bears,
if the Vikings’ offense throws an interception that is returned for a touchdown
by the Bears’ defense, the six (6) points scored by the Bears’ defense counts
toward the Total Points category of points against the Vikings as the entrant’s
Defense/Special Team.
D. Official Scoring Changes:
Although entrants will be able to track
their Fantasy Point scoring (their Perfect Picks ranking) on the $100K
Challenge Website promptly after the plays to which they relate are made, the
scoring may not be official until after the game is played. In other words, official scoring changes may
be implemented in the days following the day after games are played. Each game is reviewed for accuracy and from
time to time scoring changes are made.
These changes will be listed on the $100K Challenge Website. All statistics and standings will be updated
using these official scoring changes when they do occur. All statistics and standings are considered
official and are not subject to further change for purposes of the Competition
once the first NFL game for the next week has started (i.e., as of the first
snap of the football in the first NFL game of the subsequent week). For example, if the first NFL game of a
given week is scheduled for 8:00 pm on Thursday, the scoring for the previous
week’s games posted on the $100K Challenge Website for purposes of the
Competition is considered official as of the first snap of the football in that
scheduled 8:00 pm Thursday game.
E. Cancelled
Games
In the event that a regularly scheduled
NFL game is postponed and/or cancelled (a “Postponed Game”), Fantasy Points
will be awarded when the Postponed Game is actually played. In the event of a Postponed Game, the deadline
for selecting Players and/or a Defense/Special Team from the teams playing in
that game will remain, with respect to each team playing in such Postponed
Game, the actual (i.e., not the previously scheduled start time) NFL Team’s
Start Time for that game. In the
unlikely event that a Postponed Game occurs in week 12 of the Regular Season
Contest such that it could impact qualification for the Playoff Round, or in
the event that any other unanticipated occurrence or event interrupts or
prevents the normal operation of or any aspect of the Competition, Sponsor will
post revised rules that address any such event or occurrence, as needed (and as
determined by Sponsor, in its sole discretion), on the $100K Challenge Website.
10. QUALIFICATION FOR PLAYOFFS:
A. General:
Entrants who fall into at least one of
the categories listed below will qualify for the Playoff Round (weeks 13-17 of
the NFL Season). (Note: All
entrants who do not qualify for the Playoff Round will automatically be
eligible for entry into the Consolation Round.)
1. The top 5,000 entrants who have
received the most Fantasy Points including ties, using the best ten (10) weeks
of the Regular Season Contest.
2. All entrants tied as the 5,000th
entrant with the most Fantasy Points, using the best ten (10) weeks of the Regular
Season Contest.
3. Subject to the Perfect Picks Tiebreaker
procedures described below, all entrants who in any week during the Regular
Season Contest are one of the one hundred (100) entrants who correctly pick the
“Perfect Picks” (as described above) for that week during the Regular Season
Contest.
4. All entrants who did not qualify for
the Playoff Round by one of the first three (3) options above and whose $100K
Team was one of the top ten (10) highest scoring $100K Teams within
that entrants’ $100K Team NBC Local Affiliate Group, including ties, using the
best 10 weeks of the Regular Season Contest.
5. All entrants who did not qualify for
the Playoff Round by one of the first three (3) options above and whose $100K
Team is tied as the tenth (10th) $100K Team with the most Fantasy
Points within their respective NBC Local Affiliate Group.
When calculating the overall Fantasy
Points score for each entrant’s $100K Team for purposes of determining whether
an entrant qualifies for the Playoff Round pursuant to options 1, 2, 4, or 5
above, each $100K Team’s best ten (10) weeks will be used. In other words, if an entrant creates a
$100K Team for all twelve (12) weeks of the Regular Season Contest, that
entrant’s $100K Team’s two (2) lowest week totals will be discarded for purpose
of calculating the $100K Team’s overall Fantasy Points score. This will allow entrants to enter the
Competition after the first week of the Regular Season Contest and still be
competitive, and also it allows entrants to miss a week or more and still be
competitive.
C. Qualification
Via Perfect Picks:
If an entrant selects the Perfect Picks
correctly in any given week and there are less than one hundred (100) entrants
who also selected the Perfect Picks correctly, such entrant will automatically
qualify for the Playoff Round.
D. Perfect
Picks Tiebreakers:
If more than one hundred (100) entrants
are able to select the Perfect Picks correctly in any single week, the series
of tiebreakers described below will be employed. To begin with, when entrants are selecting their $100K Team each
week on the $100K Challenge Website, they will be asked to fill in their
prediction for the home team score and away team score of the NBC Sunday Night
Football game for that week.
Then, the entrants with the following
choices (relating to the score of the NBC Sunday Night Football Game for that
week) will advance until the total number of qualifying entrants who selected
the Perfect Picks correctly is equal to or less than one hundred (100):
1.
Closest to Total Cumulative Score
(calculated as home team score plus away team score)
2. Closest to Home Team Score
3. Closest to Away Team Score
If there are still more than one hundred
(100) entrants who selected the Perfect Picks correctly for that week after the
foregoing steps are taken, the earliest one hundred (100) Perfect Picks that
were submitted for that week will qualify for the Playoff Round. Time of submission is the time (Eastern
Time) when an entrant last saved his/her Perfect Picks. For example: If on September 7, 2007 at 11:00 AM an entrant initially sets
his/her Perfect Picks, and then submits changes on September 8, 2007 at 11:00
AM, the latter time (September 8, 2007 at 11:00 AM) will be defined as the
entrant’s time of submission for the purposes of the Perfect Picks tiebreaker.
11. PLAYOFF ROUND
A. General:
The Playoff Round will take place over
the last five (5) weeks of the NFL Season (Weeks 13-17). For the Playoff Round, the Competition will
reset and start over. All entrants’
Fantasy Points scores will be set back to zero and all Player restrictions
lifted.
The rules for the Playoff Round will be
the same as the Regular Season Contest except as otherwise noted herein.
In the Playoff Round, all five (5) weeks
will count. An entrant’s lowest scoring
week(s) WILL NOT be dropped as they were in the Regular Season Contest.
After the five (5) week Playoff Round,
the entrant with the highest Fantasy Points score for the Playoff Round will be
recognized as the champion (the “Winner”) and will be the potential Playoff
Round Grand Prize Winner of the one hundred thousand dollar ($100,000) prize
(see below).
B. Playoff Round
Tiebreakers:
If there is a tie between two (2) or more
entrants as of the conclusion of the Playoff Round, the series of tiebreakers
described below will be employed.
First, in the event of a tie at the
conclusion of the Playoff Round between two (2) or more entrants, Sponsor will
attempt to break that tie by determining whether (among those tied entrants) a
single entrant has the highest Fantasy Points total during the Playoff Round in
the following categories in the following order and if so (at any point during
the process), he/she will designated as a potential Playoff Round winner: (1)
total points for the Quarterback 1 and Quarterback 2 $100K Roster Positions
combined, (2) total points for Running Back 1 and Running Back 2 $100K Roster
Positions combined, (3) total points for the Wide Receiver 1, Wide Receiver 2,
and Wide Receiver 3 $100K Roster Positions combined, (4) the Tight End $100K
Roster Position, (5) the Place Kicker $100K Roster Position, (6) the NBC SNF
Player $100K Roster Position, and finally (7) the Defense/Special Team $100K
Roster Position.
If there remains a tie among two (2) or
more entrants after the foregoing steps have been taken, then using the NBC
Sunday Night Football Game score for week 17, each entrant’s prediction
(relating to the score of the NBC Sunday Night Football Game for that week,
which each entrant is asked to predict when they select his/her $100K Team each
week, as described above) will examined to see if a sole winner can be
determined using the following steps (in the order that they are listed):
1. Closest to Total Cumulative Score
(Defined as Home Team Score + Away Team Score)
2. Closest to Home Team Score
3. Closest to Away Team Score
If there is still a tie among two (2) or
more entrants, the same steps will be repeated with respect to the week 16 NBC
Sunday Night Football Game. If the tie
still cannot be broken, these steps will be repeated with respect to each
previous week’s NBC Sunday Night Football Game going back through week 13.
If there are still more than two (2)
entrants that are tied after the above steps are taken, the earliest submission
from among all entrants’ $100K Team selections in week 17 will be used. If the tie still cannot be broken, the
earliest entry from week 16 will be used.
If the tie still cannot be broken, this process will be repeated with
respect to each previous week’s NBC Sunday Night Football Game going back
through week 13.
Time of submission is the time (Eastern
Time) when an entrant last saved his/her $100K Team selections. For example: If on September 7, 2007 at 11:00 AM an entrant initially sets
his/her $100K Team selections, and then submits changes on September 8, 2007 at
11:00 AM, the latter time (September 8, 2007 at 11:00 AM) will be defined as
the entrant’s time of submission of his/her $100K Team selections for purposes
of the Playoff Round tiebreaker.
If there is still a tie, Sponsor will
contact entrants with a special tiebreaker trivia question that will be
selected by Sponsor in its sole discretion.
12. CONSOLATION ROUND:
The same procedures and rules that apply
to the Playoff Round apply to the Consolation Round.
13. WINNER
SELECTION:
A. Playoff Round
Winners:
Winners will be determined based upon the
number of Fantasy Points each entrant has accumulated throughout the Playoff
Round (an entrant’s “Playoff Score”).
All winning scores are subject to verification by Sponsor, whose
decisions are final and in its sole discretion.
1. Playoff Round Grand Prize Winner: The entrant who has the highest Playoff
Score.
2. Playoff Round First Prize Winners: The entrants who have the second (2nd)
through the fifth (5th) highest Playoff Scores.
3. Playoff Round Second Prize Winners: The entrants who have the sixth (6th)
through the twenty-fifth (25th) highest Playoff Scores.
B. Consolation
Round Winners:
Winners will be determined based upon the
number of Fantasy Points each entrant has accumulated throughout the
Consolation Round (an entrant’s “Consolation Score”). All winning scores are subject to verification by Sponsor, whose
decisions are final and in its sole discretion.
1. Consolation
Round Grand Prize Winner: The entrant who has the highest Consolation
Score.
2. Consolation Round First Prize
Winners: The entrants who have the
second (2nd) through the fifth (5th) highest Consolation
Scores.
3. Consolation
Round Second Prize Winners: The entrants who have the sixth (6th)
through the twenty-fifth (25th) highest Consolation Scores.
C. Contacting Winners:
Sponsor will make two (2)
attempts to contact potential winners at the phone number or e-mail address
provided at time of entry. If Sponsor
is unable to reach a potential winner via phone or email after two (2)
attempts, he/she may be disqualified and an alternate may be selected. Potential winners may be required to
complete, sign, have notarized and return an Affidavit of Eligibility and
Liability Release (“Affidavit and Release”) and Publicity Release (where legal)
within five (5) days of date of attempted delivery. Noncompliance within this time period, with these Official Rules
or the return of or inability to deliver any prize/prize notification may
result in disqualification and/or forfeiture of any prize and, at Sponsor’s
discretion, and time permitting, an alternate potential winner may be selected.
14. PRIZES:
Playoff Round Grand Prize: One Hundred Thousand Dollars ($100,000)
payable in the form of a check.
Playoff
Round First Prize:

Retail Value is $300.

Round Second Prize:

Only
the manufacturer’s limited warranty, if any, shall apply to the prizes awarded
and no other warranty, representation or guarantee is provided to any winner
with respect to any prize. All prize
details not specified herein are at the sole discretion of the Sponsors. All federal, state and local taxes and all other costs
associated with acceptance or use of prizes, not specified herein, are the sole
responsibility of the winner(s). Arrangements for delivery of prizes will be
performed after winner validation. Any
depictions of any prize are for illustrative purposes only. No
cash or other prize substitution, assignment or transfer of any prize is
permitted by any winner, except that Sponsor reserves the right, in its sole
discretion, to substitute a prize of comparable or greater value. The
decisions of Sponsor are final and entrants agree to be bound by these decisions. In the event that any prize component is not
available for any reason, then remaining elements of prize shall constitute
full satisfaction of Sponsor’s prize obligation to winner and no additional
compensation will be awarded.
15. CONDITIONS
OF PARTICIPATION:
By entering this Competition, entrants agree to be bound by
these rules and decisions of Sponsor, which shall be final and binding in all
respects. By entering
this Competition, where
legal, by being an entrant or winner, you consent to the use of your name,
voice, and likeness, photograph in and in connection with the development,
production, distribution and/or exploitation of the Competition. Winners agree that from the date of notification
by Sponsor of their status as a potential winner and continuing until such time
when Sponsor informs them that they no longer need to do so that they will make
themselves exclusively available to Sponsor for publicity, advertising and
promotion activities, and must agree not to allow interviews by other media
outlets, including television, magazines, newspapers, radio and Internet,
unless authorized by Sponsor. Sponsor
and Sponsor’s Promotional Partners reserve the right to make public personal information
about the entrants and winner(s), on-air, on the Internet, or otherwise, prior
to, during, or following the Competition.
In all disputes, Sponsor is the sole judge and its actions are final and
binding. Sponsor may announce any winner’s name on-air or on its website.
Sponsor,
in its sole discretion, may disqualify any entrant from the Competition, refuse
to award Fantasy Points or prizes and require the return of any prizes, if
entrant engages in conduct Sponsor deems to be improper, unfair or otherwise
adverse to the operation of the Competition or in any way detrimental to other
entrants. Improper conduct includes, but is not limited to: falsifying personal
information required to enter the Competition or claim a prize; violating any
of these rules, accumulating points or prizes through unauthorized methods such
as automated scripts or other automated means; tampering with the
administration of the Competition or trying to in any way tamper with the
computer programs associated with this Competition; obtaining other entrants
information and spamming other entrants; and abusing the $100K Challenge
Website in any way. Entrant further
acknowledges that the forfeiture and/or return of any prize shall in no way
prevent Sponsor from pursuing criminal or civil proceedings in connection with
such conduct. Further this Competition
MAY NOT BE USED FOR ANY FORM OF GAMBLING.
Sponsor
reserves the right to modify these rules for clarification purposes without
materially affecting the terms and conditions of the Competition. By entering into this Competition or
accepting any prize, entrants, including but not limited to the winner(s),
agree to release and to hold harmless Sponsor and Sponsor’s Promotional
Partners and each of their respective parents, subsidiaries, affiliates and
agencies, as well as the officers, directors, employees, shareholders and
representatives of any of the foregoing entities (collectively, the “Released
Parties”) from any and all liability, claims or actions of any kind whatsoever,
including, but not limited to, for injuries, damages or losses to persons and
property which may be sustained in connection with participation in the
Competition, the receipt, ownership, use or misuse of any prize or while
preparing for, participating in and/or travelling to or from any prize related
activity, and claims based on publicity rights, defamation or invasion of
privacy.
Sponsor
and Sponsor’s Promotional Partners are not responsible for: any incorrect,
invalid or inaccurate entry information; human errors; postal delays/postage
due mail; technical malfunctions; failures, including public utility or
telephone outages; omissions, interruptions, deletions or defects of any
telephone system or network, computer online systems, data, computer equipment,
servers, providers, or software (including, but not limited to, software and
operating systems that do not permit an entrant to participate in the
Competition), including without limitation any injury or damage to any
entrant’s or any other person’s computer or video equipment relating to or resulting
from participation in the Competition; inability to access any
website, or any
web pages of the Sponsor; theft, tampering, destruction, or unauthorized access
to, or alteration of, entries and/or images of any kind; data that is processed
late or incorrectly or is incomplete or lost due to telephone, postal issues,
computer or electronic malfunction or traffic congestion on telephone lines or
transmission systems, or the Internet, or any service provider’s facilities, or
any phone site or website or for any other reason whatsoever; typographical,
printing or other errors, or any combination thereof. Sponsor and Sponsor’s
Promotional Partners are also not responsible for incomplete, illegible,
misdirected or stolen entries. If for any reason the Competition is not capable of running as
originally planned, or if the Competition or website associated therewith (or any
portion thereof) becomes corrupted or does not allow the proper entry to the
Competition and processing of entries or votes in accordance with these
Official Rules, or if infection by a computer (or similar) virus, bugs,
tampering, unauthorized intervention, actions by entrants, fraud, technical
failures, or any other causes of any kind, in the sole opinion of Sponsor
corrupts or affects the administration, security, fairness, integrity or proper
conduct of the Competition, Sponsor reserves the right, in its
sole discretion, to disqualify any individual implicated in such action and/or
to cancel, terminate, extend, modify or suspend the Competition, and select the winner(s)
from all eligible entries received. If such cancellation, termination,
modification or suspension occurs, notification will be posted on the $100K
Challenge Website.
ANY
ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY PHONE
SERVICE SITE OR WEBSITE (INCLUDING THE $100K CHALLENGE WEBSITE) OR UNDERMINE
THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND/OR
CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES
AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY
LAW.
All
entries become the property of Sponsor and will not be acknowledged or
returned. Winners may be requested to provide Sponsor with proof that the winner is
a resident at the address provided on the registration screen and that all
eligibility requirements are met. In the event of a dispute as to the identity
or eligibility of an entrant or winner based on an e-mail address, the
applicable entry will be declared made by the authorized account holder of the
e-mail address submitted at time of entry.
"Authorized account holder" is defined as the natural person
21 years of age or older who is assigned to an e-mail address by an Internet
access provider, on-line service provider or other organization (e.g.,
business, education institution, etc.) that is responsible for assigning e-mail
addresses for the domain associated with the submitted e-mail address.
All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, or the rights and
obligations of any entrant, Sponsor or the Released Parties in connection with
the Competition, shall be governed by and construed in accordance with the laws
of the State of New York without giving effect to any choice of law or conflict
of law rules or provisions which would cause the application of the laws of any
jurisdiction other than the State of New York.
If any controversy or claim arising out of or relating to the Competition,
the Official Rules, or the breach of any term hereof, cannot be otherwise
resolved, it shall be resolved by binding arbitration conducted in the County
of New York, and administered by Judicial Arbitration and Mediation Services
(“JAMS”) in accordance with its Streamlined Arbitration Rules and Procedures or
subsequent versions thereof (“the JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed,
except that the arbitrator shall be an experienced arbitrator licensed to practice
law in New York. The decision of the
arbitrator shall be binding, final and conclusive and shall not be appealable
to any court.
Participation
in the Competition must
be made only as specified in these Official Rules. Failure to comply with these Official Rules will result in
disqualification and, if applicable, prize forfeiture.
The failure of Sponsor to comply with any provision of
these Official Rules due to an act of God, hurricane, war, fire, riot,
earthquake, terrorism, act of public enemies, actions of governmental
authorities outside of the control of Sponsors (excepting compliance with
applicable codes and regulations) or other force majeure event will not be
considered a breach of these Official Rules.
16. LIST OF WINNERS:
For the Winner and Winner’s name, send a self-addressed
stamped envelope to NBC Universal Digital Media, 30 Rockefeller Plaza, New
